About these terms
This website is operated by AXcloud Digital Pty Ltd in Perth, Western Australia. By using it, you agree to these general terms. They do not replace a project proposal or agreement. Where project-specific written terms conflict with this page, the project-specific terms take priority.
Website information
The website provides general information about a developing digital studio. It is not a promise that a particular service, outcome, price or timeframe is available. We may update the site or change the studio’s focus without notice.
Enquiries and proposals
An enquiry does not create a client relationship or obligation to proceed. Before paid work begins, we will aim to document the agreed scope, deliverables, fees, payment timing, responsibilities and expected schedule. Work outside that scope may require a written change and additional fee.
Client responsibilities
Clients are responsible for giving timely, accurate information and feedback; obtaining rights to materials they supply; nominating an authorised decision-maker; and reviewing deliverables for factual, legal and operational suitability before use.
Payments, cancellation and refunds
Payment terms will be set out in the applicable proposal or invoice. Deposits may be required to reserve time or begin work. Cancellation, postponement and refund arrangements depend on the project stage, work completed and commitments already made, and will be governed by the project-specific terms and applicable Australian Consumer Law.
Intellectual property
Ownership and licence terms will be stated in the project agreement. Unless otherwise agreed, pre-existing tools, working methods, reusable code, typefaces, stock assets and third-party materials remain subject to their existing ownership or licences. Drafts and unused concepts are not automatically included in a final handover.
AI and third-party tools
We may use AI-assisted and other third-party tools where appropriate, subject to project needs and confidentiality considerations. Their use does not remove our responsibility to review the work we deliver. Third-party services, platforms and licences may have their own terms, fees and availability limits.
No legal or registration guarantee
Creative and technical work is not legal, accounting or trademark advice. Unless specifically agreed, we do not guarantee that a name, logo, domain, design or other asset can be registered, is legally available, or will be free from all third-party claims. Specialist advice and formal searches remain the client’s responsibility.
Liability
Nothing in these terms excludes rights that cannot lawfully be excluded, including applicable rights under Australian Consumer Law. To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of this general website. Project liability will be addressed in the relevant agreement.
